वाराणसी जिला अदालत (Varanasi District Court) आज इस मुद्दे पर अपना फैसला सुना सकती है कि ज्ञानवापी का मुकदमा चलने योग्य है या नहीं? मुस्लिम पक्ष की याचिका पर फैसला आएगा, जिसमें मुस्लिम पक्ष ने कहा था कि ज्ञानवापी का वाद (मुकदमा) 1991 के पूजा स्थल विधेयक का उल्लंघन है. इसलिए यह मुकदमा नहीं चल सकता है. जबकि, हिंदू पक्ष ने कहा कि ज्ञानवापी का मुकदमा 1991 के पूजा स्थल विधेयक कानून का उल्लंघन नहीं है, पहले धार्मिक स्वरूप तय हो तब पता चलेगा कि पूजा स्थल विधेयक इस पर लागू होता है या नहीं.

काशी विश्वनाथ मंदिर और ज्ञानवापी मस्जिद को लेकर आधा दर्जन से ज्यादा मुकदमे अलग-अलग अदालतों में लंबित हैं, लेकिन, यह मामला बेहद खास है, क्योंकि तत्कालीन सिविल जज रवि कुमार दिवाकर ने इसी मामले पर सर्वे के आदेश दिए थे, जिसमें मस्जिद के वुजूखाने में शिवलिंग होने का दावा किया गया था. हालांकि, मुस्लिम पक्ष ने इसे फव्वारा बताया था और आज भी अपने दावे पर कायम है. वहीं, हिंदू पक्ष का दावा है कि ज्ञानवापी मस्जिद का पूरा ढांचा मंदिर को तोड़कर बनाया गया है.

Varanasi District Court is likely to give its verdict on the issue today whether Gyanvapi's case is maintainable or not? The decision will come on the petition of the Muslim side, in which the Muslim side had said that the suit (litigation) of Gyanvapi is a violation of the 1991 Place of Worship Bill. Hence this case cannot be pursued. Whereas, the Hindu side said that the case of Gyanvapi is not a violation of the 1991 Place of Worship Bill Act, first the religious character is decided, then it will be known whether the Place of Worship Bill applies to it or not.

More than half a dozen cases are pending in different courts regarding Kashi Vishwanath Temple and Gyanvapi Masjid, but, this case is very special, because the then Civil Judge Ravi Kumar Diwakar had ordered a survey on the same matter, in which the mosque's Wuzukhana It was claimed to be a Shivling. However, the Muslim side had called it a fountain and still stands by its claim. At the same time, the Hindu side claims that the entire structure of the Gyanvapi Masjid has been built by demolishing the temple.
